It is a European Union regulation designed to protect human health and the environment from risks associated with chemicals.

REACH applies to substances manufactured or imported into the European Economic Area (EEA). It can apply to chemicals supplied on their own, in mixtures, and in certain articles.

For an Indian exporter, REACH compliance becomes particularly important when exporting chemicals, chemical mixtures, or products containing regulated substances to the EU/EEA.

Important: REACH is not simply a single “certificate” issued by the Indian Government. Depending on the product and situation, compliance may involve registration with the European Chemicals Agency (ECHA), documentation, testing/data, restrictions and communication requirements.

When Is REACH Compliance Required?

REACH requirements depend on the product, substance, quantity, intended use and role of the parties in the supply chain.

For substances, registration is generally required when a substance is manufactured or imported into the EU/EEA at 1 tonne or more per year per manufacturer/importer, subject to applicable exemptions.

REACH can also apply to:

Chemicals and chemical substances

Substances contained in mixtures

Certain articles/products containing substances

Substances on the Candidate List of Substances of Very High Concern (SVHC)

Products subject to specific REACH restrictions

A substance may be subject to restrictions even when registration is not required, including in some cases below the 1-tonne threshold.

REACH is substance-based, so the requirement depends on what substances are present, their quantity/concentration, how the product is classified, and how it is placed on the EU market.

For finished articles such as clothing, furniture, leather, bicycles, toys or electronic products, plastic, etc. the key question can instead be whether they contain Candidate List SVHCs, restricted substances, or substances intended to be released. ECHA specifically identifies articles such as clothing, furniture, bicycles, batteries and T-shirts within the REACH framework.

Note: REACH should not be treated as a universal certificate for exporting to every country in Europe. Countries outside the EU/EEA can have their own chemical regulations.

How to apply for “REACH “?

There is an important distinction between REACH registration and a document commonly called a “REACH certificate.”

ECHA’s official process is based on registration and compliance obligations, rather than issuing one universal REACH certificate for every product. Registration involves submitting the required dossier to ECHA through REACH-IT.

REACH IT is https://echa.europa.eu/en/regulations/reach/registration

ECHA describes the formal process as REACH registration, involving a registration dossier, rather than a universal certificate.

Therefore, an Indian exporter should first determine what specific REACH obligation applies to the product rather than simply purchasing a generic “REACH certificate.”

REACH Compliance Checklist for Indian Exporters

Chek

What to Verify

Product

Chemical, mixture or article?

Substance

CAS/EC number and composition

Quantity

EU/EEA annual tonnage

Registration

Is registration required?

SVHC

Does it contain a Candidate List substance?

Restrictions

Is the substance restricted?

EU party

Importer or Only Representative

Documents

SDS, test reports, declarations, registration details

Buyer

Confirm the buyer’s specific REACH requirements

Conclusion

REACH compliance is important for Indian exporters supplying chemicals, mixtures and certain articles to the EU/EEA.
